Terms and Conditions

Resumes by Lana provides these Terms and Conditions Agreement (the “Agreement”) which is between you (the “Client”) and Resumes by Lana (the “Company”), an Australian Business with an address of 24 Melomys Circuit, Throsby, Australian Capital Territory, 2914.

These Terms and Conditions govern the sale of services available on this Site www.resumesbylana.com (the ‘Site’).  This Site is owned and operated by Lana McMurdo. This Site is an eCommerce website.  By using this Site, you indicate that you have read and understood these Terms and Conditions and agree to abide by them at all times. 

The following services are available on this Site: 

·       Job application support; including but not limited to Resumes, Cover Letters, Pitch Responses, Statement of Claims, Selection Criteria Responses; and 

·       Job search support, interview coaching and virtual consultations

All works will commence after receipt of full payment for services through Stripe payments or Bank Transfer to Resumes by Lana to hold the Client’s position. Works are completed on a payment priority basis. As a result, timeframes for completion may vary from those initially quoted. The Client understands that services provided by Resumes by Lana are personalised, as a result, payment is non-refundable and cannot be cancelled except as outlined in these Terms and Conditions.

Payment Terms

The Client and the Company agree that this is a binding contract. By making payment to the Company for services, the Client agrees to and accepts this Terms and Conditions Agreement Failure to read the Terms and Conditions Agreement in its entirety does not constitute waiving the Terms and Conditions or its application/s.

Payment for all Services must be finalised before the Company commences work on any Client project/s and can be made through Stripe payments or Bank Transfer. Invoices unpaid from 7 days of issue date will be deemed void, a new quote will need to be requested. In the event of unsuccessful payment for any reason, the Client will remain legally liable for agreed-upon payment amounts. The Company reserves the right to update or change pricing on this website at any time.

Refunds/Cancellations

The Company provides tailored and personalised writing and consultation services. Working with the Client, significant time and work effort goes into preparing to assist you with the preparation of your documents, or in preparation for your consultations. As a result, the Company does not provide a refund for services after purchase. Services are valid for us within three months from the purchase date, unless otherwise advised. If you wish to cancel your service before the resume writer commences the works, a refund will be issued less than 10% to account for administrative costs. No circumstances will warrant a monetary refund after 60 days from the placement of your order. However, a credit may be issued to your account at the discretion of the Company.

Confidentiality

The Company will only use Confidential Information provided by the Client to perform services. Confidential information shall be stored on Company systems. If the Client requests the removal of stored Confidential Information, this request must be made in writing to the Company.

Delivery of Documents

The Company aims to deliver the first draft of the Client’s documents within three business days of the Client’s completed work history questionnaire and/or first phone consultation. The delivery timeframe begins once the Company has all the information required to commence work on your documents, following completion of your questionnaire and/or consultation. Please ensure you provide a minimum of three business days before an application deadline prior to purchasing services. The Company cannot be held responsible for missed deadlines. These timeframes for delivery can vary during peak periods and may be up to ten business days.

For express orders requested for delivery within one business day of completion of required Client information, a $100 surchage will apply per document. Express orders must be submitted in writing through email to the Company, and you will be advised whether your request for express order can be accommodated with consideration to the current workloads of the Company.

Your documents will be provided as files in PDF and Microsoft Word format. The Company will assist you to the best of the Company’s ability in resolving any such issues, however, cannot be held liable for incompatibility issues with your computer set-up. The Company does not create documents in any other format, including but not limited to Apple Pages or Google Docs.

Change of Direction Throughout the Works

The Company’s writing and consultation processes are based on your initial request at the time of Client intake, and following completion of the Client Questionnaire and/or initial phone consultation. Following the initial draft of the Client documents (including but not limited to Resume, Cover Letter, Selection Criteria, Statement of Claims, Pitch and/or LinkedIn write-up), if the Client elects to change career direction and amend the direction of the documents or add in a new role, this will incur additional fees.

Where the Client requires additional consulting and writing time outside of the initial scope of work and after the initial draft of Client documents, additional writing/consulting time is billable to the Client at the Company’s hourly rate of $109 per hour.

Acceptance Period and Additional Works outside of Scope of Work

The Client must approve all documentation, ensuring a true and accurate representation of their completed documentation within seven days of delivery. All documents will be created based solely on the information you provided and do not constitute legal, professional or commercial advice. After seven days, the works with be considered approved and complete. The Company will provide up to three rounds of revisions within the 10 business day window. Whereby the Client requests revisions beyond the ten business day window, an additional fee would be incurred. The Company makes every effort to ensure the document is free of errors, however, proofreading the document for accuracy is the responsibility of the Client. It is solely the Clients responsibility to ensure information is a true and accurate representation of information that can be substantiated.

Failure of the Client to participate in the editing process, revision and approval of documentation will result in acceptance of the Client’s documents as the final draft/s, and the Company will not be responsible for further works. Additional works required outside of scope or following the acceptance of the Client’s documents as the final draft/s will incur an additional fee.

Works will be closed out within 10 days of the delivery date for all documentation provided.

The Company will own the works until works are considered accepted and complete. The Client agrees not to use the works in any format until the work is fully accepted and completed.

Consultations

Consultations are carried out over various formats, including phone calls, Zoom, Google Meet and/or Microsoft teams. All consultations are scheduled for specified timeslots to ensure the works can be completed promptly. All conversations are documented and time-stamped, providing the Client and Company records and information are accurately maintained and for future reference, as required.  

The Success of Job Applications

The Client acknowledges that various factors are involved in the success of a job application outside of the services provided by the Company. The results achieved in their job search are solely the Client’s responsibility. Various factors include but are not limited to; market conditions, job availability, compensation expectations, Client interview skills, and any amendments made to the finalised documentation by the Client.

Document Preferences

Your resume writer has a background in the Recruitment and Human Resources Profession and prepares your documents based on current industry standards and keywords to increase the chances of your application/s being progressed. Your preferences may differ from industry standards adhered to by your resume writer and will be implemented at your request. However, this will not guarantee the document/s will increase the chances of your application progressing.

Non-disparagement

The Company and the Client agree not to make any negative or disparaging remarks, including negative or disparaging comments on the Internet or in any other public forum.

Warranties and Liability

The Client accepts that the service is subjective to a degree, opinions vary, and the Company cannot guarantee improvement to your job prospects. In no event will the Company be liable for any incidental, indirect, consequential or special damages of any kind, including but not limited to personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, missed deadlines and breach of contract or otherwise, even if foreseeable, or any damages whatsoever arising out of or in connection with the use of our services or our site and any websites linked to or from it. Under no circumstances shall the Company be liable to you for any amount for services rendered under this agreement. To the maximum extent permitted by applicable law, you hereby release and waive all claims against the Company from any liability for claims, damages (actual and consequential), costs and expenses (including litigation costs and attorney’s fees) of every kind and nature, arising out of or in any way connected with the use of the Service or Site. The preceding does not affect any liability which cannot be excluded or limited under applicable law.

Indemnity

Except where prohibited by law, by using this Site, you indemnify and hold harmless the Company of Resumes by Lana and affiliates from any actions, claims, losses, damages, liabilities and expenses, including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

The Services are provided on a best endeavors basis based on the content and information provided by the client. The Company will not be held liable for any misrepresentations or any misleading statements or incorrect information.  By accepting the Services and utising the output provided by The Company with prospective employers and recruiters the Client accepts all responsibility for the accuracy of the content.

Intellectual Property

By using this website, you acknowledge and agree that all copyright and other intellectual property rights in all website material, including site design, logos, site structure, graphics and all software and codes, are vested in the Company. You are permitted to use this material only as expressly authorised by the Company.

You can only print and use materials on this website to evaluate whether to place an order with the Company, and any other use of website material is strictly prohibited.

Acceptable Use

As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to: 

·       Harass or mistreat other users of our Site;

·       Violate the rights of other users of our Site;

·       Violate the intellectual property rights of the Site owners or any third party to the Site;

·       Hack into the account of another user of the Site; or

·       Act in any way that could be considered fraudulent. 

If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps to prevent you from accessing our Site. 

Disclaimer

All information and materials available on this website are for educational purposes only. The reliability of advice, statements or any other information displayed through the website should not be the sole determiner for the Client’s decisions relating to employment or other career matters. By accepting these terms and conditions, you acknowledge that as the Client, you consider your situation and use the information and materials on this website at your own risk.

The results, testimonials and reviews on this website do not reflect your chances of success.

These Terms and Conditions may be amended from time to time to maintain compliance with the law and to reflect changes to how we operate our Site and how we expect users to behave on our Site. The Company will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
